Cloud Availability is a policy governing the availability and use of Advance2000 Cloud (A2C) Computing Systems, including, but not limited to, desktops, servers, backups and telephony (“Advance2000 Cloud or A2C”) between Advance2000, Inc. (“A2000” or “We”) and our Clients (“You”).
A2000 will use commercially reasonable efforts to make A2C available with a Monthly Uptime Percentage of at least 99.9%, in each case during any monthly billing cycle (the “Service Commitment”). In the event A2C does not meet the Service Commitment, You will be eligible to receive a Service Credit.
- Monthly Uptime Percentage is calculated by subtracting from 100% the percentage of minutes during the month in which A2C was unavailable
- Monthly Uptime Percentage measurements shall exclude downtime resulting from Internet or Wide Area Networks connecting You to the A2C
Service Commitments and Service Credits
Service Credits for unavailability are calculated as a percentage of the total charges paid by You and limited to the service that was down and shall exclude one-time payments made for A2C setups and installations.
